Planning compliance check Venice: in brief. It is the check that the current state of a property matches the building permits that authorised its construction and later alterations, that is, its legitimate status (stato legittimo). It matters above all when selling, applying for a mortgage, settling an inheritance or before carrying out works. It always starts with the access-to-records request, from €150; the rest depends on the type of property and the searches required.

How the check is carried out

The work is carried out through a series of technical and documentary checks aimed at verifying the property’s compliance from a planning, building and cadastral standpoint. The main activities include:

  • accessing records at the relevant Municipality;
  • retrieving and analysing the authorised building plans;
  • checking the property’s building permits;
  • a technical site visit;
  • a metric survey of the property;
  • comparing the actual condition with municipal documentation;
  • checking cadastral compliance;
  • drafting a technical report with the findings.

Each check is carried out with the aim of providing a clear, objective and well-documented assessment of the property’s situation.

Why rely on a specialised professional

A check carried out before buying or selling a property makes it possible to:

  • know the property’s actual planning and cadastral situation;
  • avoid problems during the signing of the deed;
  • reduce the risk of disputes;
  • plan any necessary regularisation works;
  • increase the property’s value and marketability;
  • handle any building permit application with greater confidence.

The aim is to offer complete technical consultancy, giving clients all the information they need to make informed decisions and protect their investment.

Building Regularisation (Sanatoria): What to Do About Non-Compliance

When the compliance check reveals a discrepancy between the actual condition of the property and its building permits, in many cases it is possible to proceed with a building regularisation (known in Italy as “sanatoria edilizia”) with the relevant Municipality. The process involves identifying the non-compliance, assessing whether it can be regularised under current planning regulations, preparing the building application and coordinating with the municipal technical office through to obtaining the regularised permit. Handling this process with the assistance of a qualified engineer helps avoid errors in the application and speeds up regularisation times, both in Venice and across the Veneto region. When the discrepancy has to be documented with a precise record of the property’s actual condition, the process relies on a laser scanner survey for building regularisation.

Planning Compliance Check Venice: When It Is Necessary

A planning compliance check Venice is essential before any sale, donation or inheritance of a property, since the law requires the actual state of a building to match the building permits filed with the Municipality. Responsibility for the compliance declaration falls on the seller, but a preliminary technical check protects both parties involved in the transaction.

A planning compliance check Venice is carried out by comparing the real condition of the building, surveyed on site, with the documentation held in the municipal archive, including building licences, permits and their variations, in accordance with the Italian Consolidated Building Act (D.P.R. 380/2001). The analysis also includes a comparison with the cadastral floor plans filed with the Revenue Agency, to verify that the graphic representation of the property matches its actual condition.

When discrepancies emerge between the actual state and the building permits, a planning compliance check Venice allows the firm to assess whether a building regularisation (sanatoria) is feasible, identifying the most effective technical solution before a sale or mortgage application. In many cases the regularisation requires payment of a fine and a simplified building permit application, with processing times that vary depending on the competent Municipality.

The firm carries out a planning compliance check Venice, Treviso and Padua for private owners, estate agencies and notaries, providing a detailed technical report useful for closing a sale with certainty and no surprises, integrating the service with a energy performance certificate when the property also needs an updated energy class before the sale.

Planning compliance: frequently asked questions

Can I sell a property with a building irregularity?

It depends on the irregularity. A constructional tolerance (art. 34-bis, Presidential Decree 380/2001, D.P.R. 380/2001) does not prevent the sale. A regularisable irregularity must be regularised beforehand or in agreement with the buyer and the notary. For an irregularity that cannot be regularised, the solution is normally restoration of the lawful condition.

How long does a planning compliance check take?

No timescale is guaranteed. The duration depends mainly on how long the municipality takes to grant access to its records, which varies with the archive, the type of search and the time of year. The firm keeps you updated on the status of the request.

How much does a compliance check cost?

It always starts with the access-to-records request, from €150. The cost of the later phases depends on the type of property and the searches required: the general archive consulted by hand, an online request, or access at the Soprintendenza for listed properties. A written quote is provided.

What is the difference between planning compliance and cadastral compliance?

Planning compliance compares the actual state of the property with the building permits. Cadastral compliance compares it with the floor plan filed in the land registry (catasto). They are two separate checks: a correct cadastral plan does not prove that the property is regular from a building-law point of view.

How does it work for buildings constructed before 1967?

If the building was constructed when a permit was not mandatory, art. 9-bis, paragraph 1-bis, D.P.R. 380/2001 accepts the original cadastral records (informazioni catastali di primo impianto) and other supporting documents. Examples are photographs, cartographic extracts and archive documents. In built-up areas a building licence was already required by Law 1150/1942, and some municipal building regulations required one even earlier: archive research therefore remains important. The assessment is made case by case.

What do I need to provide to get started?

We need the address and cadastral data (sheet, parcel, sub-unit), the cadastral extract and floor plan, the deed of title and any building permits you hold. If some are missing, the firm retrieves them through the access-to-records request.
